General terms and conditions of supportyourlocalartist.ch  

1. Scope

These general terms and conditions (" GTC ") apply to all legal transactions that are concluded via the platform www.supportyourlocalartist.ch. The platform is operated by somewhere LAB GmbH, Augustinergasse 17, 9000 St. Gallen.

The supportyourlocalartist.ch platform only assumes the role of mediator and is the direct representative of the artists.

2nd offer

The supportyourlocalartist.ch offer is aimed at customers over the age of 18 who are capable of acting and who are resident in Switzerland or the Principality of Liechtenstein.

After placing the order, the customer receives a confirmation of receipt of the order, which also counts as an invoice.

3. Order and Delivery

Orders are accepted via the platform www.supportyourlocalartist.ch. If the product is only available at a later date, the order will be placed on backorder. If, after the confirmation of receipt of the order, it is determined that an item cannot be delivered, the customer will be informed that the corresponding order must be cancelled.

The orders are forwarded to the artists and the delivery takes place within 2-4 days directly from the artists' studios.

Deliveries are made exclusively to addresses in Switzerland and the Principality of Liechtenstein. In principle, deliveries are only made to the customer's curb/PO Box

The customer undertakes to check the delivered goods immediately for correctness, completeness and integrity. Damage to the delivered goods must be reported to the transport company or supportyourlocalartist.ch as soon as possible, but no later than 5 calendar days after delivery. We will forward the case to the artist and they will contact the customer. In the event of complaints, all parts of the original packaging must be kept. These may only be disposed of with the written consent of the transport company or the artist.

The purchase offer will be acknowledged by an email from order@supportyourlocalartist.ch.

5. Conclusion of contract

In the event of the conclusion of a contract, a contract (purchase offer) is concluded between the artist and the consumer.

A purchase offer comes about through the successful completion of the following procedure 'Order Process'.

6. Prices

Artists have the right to change prices at any time. The price that is published at the time of the order applies. Price changes made after the order has been placed will not be taken into account.

Technical changes, errors and misprints are reserved. All prices include credit card fees, shipping and VAT.

7. Payment 

7.1 Payment Methods

Payments must be made in Swiss francs.

Credit cards (Visa, Mastercard, Apple Pay, AMEX, TWINT and prepayment) are accepted as means of payment.

When paying by credit card, the debit is made when the order is placed.

8. Procedure for Defective Products

The customer can claim a defect in the product, provided there are no grounds for exclusion. Reasons for exclusion may include, in particular, elementary damage, moisture damage, impact or fall damage, natural wear and tear, incorrect manipulation and damage caused by external influences.

If there is a defect that does not fall under the grounds for exclusion, the customer will contact supportyourlocalartist.ch personally and the case will be forwarded to the artist. In any case, the return must be agreed with the artist in advance.

Defective products will not be picked up. The customer must send the defective product to the artist at his own expense and risk or hand it in at the designated location. The products are to be sent in with all accessories in the original packaging, stating an order number assigned by the artist for the return of the goods. If the original packaging is missing, the product must be packed in a transportable manner.

9. Return and Refund Policy

For returns, the customer must contact support at orders@supportyourlocalartist.ch, after which we will take care of the case together with the customer. Orders can be returned within 5 days after consultation.

10. Advertising and Newsletters

supportyourlocalartist.ch uses Google Analytics and so-called cookies, text files that are stored on the customer's computer and enable an analysis of the use of the website.

12.Other Provisions 

11.1 Correspondence

All correspondence is handled by email to info@supportyourlocalartist.ch.

11.2 Partial Invalidity

Should individual provisions of these General Terms and Conditions be invalid or ineffective, this has no effect on the effectiveness of the remaining provisions and these General Terms and Conditions as a whole.

11.3 Jurisdiction, Applicable Law

All legal relationships between supportyourlocalartist.ch and the customer are subject to substantive Swiss law to the exclusion of the IPRG. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

The place of jurisdiction for complaints from consumers is their place of residence or St. Gallen. In all other cases, St. Gallen is the exclusive place of jurisdiction.

13. Direct representation of the artist

supportyourlocalartist.ch only acts as an intermediary and represents the artist directly. Acting on behalf of others (of the person represented) and on behalf of others (of the person represented).
